At wimsedas.com, we value and respect your privacy. This Privacy Policy describes how we collect, use, store, share and protect your personal information and device data when you use our IoT telemetry platform (our "Service").
The data controller is WIMSEDAS, with registered office in Panama City, Republic of Panama, hereinafter "wimsedas.com", "we", "us" or "our". For any matter related to this policy, you may contact us at support@wimsedas.com.
2. KEY DEFINITIONS
- "Personal Data": Any information relating to an identified or identifiable natural person ("the Data Subject"). Includes, among others, name, email address, IP address, device identifiers, etc., as defined by Law 81 of 2019 of Panama.
- "Telemetry Data": Technical information generated by your IoT devices (temperature, humidity, voltage, relay status, etc.). This data, by itself, does not usually directly identify a person and is governed by section 7 of this policy.
- "Data Subject": The natural person to whom the Personal Data belongs (you).
- "Processor": Us, wimsedas.com, as the entity that processes your Personal Data to provide you with the Service.
3. INFORMATION WE COLLECT
We collect the following types of information:
A. Account Information (Personal Data)
To create and manage your account, we need:
- Basic Identifiers: First name, last name, username and password.
- Contact Information: Email address.
- Billing Information: If you purchase a paid plan, we may collect billing data (name, address, payment information), which is securely processed by our payment provider. wimsedas.com does not store full credit card data.
- Communication Preferences: Language preferences and notification channels (e.g., Telegram chat ID).
B. Usage and Technical Data (May constitute Personal Data)
- IP address, browser type and version, operating system, device identifiers (MAC Address of your ESP32) and access logs.
- Cookies and Tracking Technologies: We use essential cookies for site functionality (login, preferences). We do not use third-party cookies for advertising purposes.
C. Telemetry Data (Not considered Personal Data under this policy)
Data generated by your sensors and actuators (temperature, humidity, relay status, etc.) is your exclusive property. wimsedas.com acts as a mere processor of this data, and we do not use it for any purpose beyond providing you the Service (visualization, storage, alerts), unless you explicitly instruct otherwise (e.g., sharing a public dashboard).
4. LEGAL BASIS AND PURPOSE OF PROCESSING
In accordance with Law 81 of 2019 of Panama, we process your Personal Data under the following legal bases:

| Consent (for marketing communications) | Send you newsletters or communications about new products or features. You may withdraw your consent at any time. |
5. DATA RETENTION
- Account Data: Will be kept as long as your account is active. If you request deletion of your account, we will initiate the cancellation process and delete your Personal Data within a maximum period of thirty (30) days, unless we need to retain it due to legal obligations (e.g., billing).
- Telemetry Data: Will be retained as established in your service plan. For free or trial plans, the retention period is 30 days. You may delete your data manually at any time through the platform interface.
6. DATA SHARING
wimsedas.com does not sell, rent or trade your Personal or Telemetry Data with third parties for their own marketing purposes. We may share your information only in the following limited cases:
- Essential Service Providers: With companies that help us operate the Service (web hosting providers, email service like PHPMailer/SMTP, payment gateway provider). These companies are subject to confidentiality agreements and may only use your data for the purposes we instruct.
- Legal Compliance: If we believe in good faith that access, use, preservation or disclosure of your information is reasonably necessary to:
- Comply with applicable law, regulation or legal process in Panama.
- Investigate and defend ourselves against third party claims.
- Protect the security, integrity or rights of wimsedas.com, our users or the public.
7. OWNERSHIP OF TELEMETRY DATA AND DISCLAIMER
- Your Ownership: You retain all ownership rights to the Telemetry Data generated by your devices.
- Accuracy: wimsedas.com does not guarantee the accuracy, completeness or reliability of Telemetry Data, as it comes from hardware devices that are your exclusive property, installation and calibration. You are solely responsible for verifying the quality and truthfulness of the data you store and view on our platform.
- Limitation of Liability (Law 81 of 2019, Art. 30): To the maximum extent permitted by law, wimsedas.com shall not be liable for direct, indirect, incidental or consequential damages resulting from the loss, corruption, misinterpretation or misuse of your Telemetry Data.
8. INFORMATION SECURITY
We implement reasonable technical, administrative and physical security measures to protect your information against unauthorized access, alteration, disclosure or destruction. These include:
- Encryption: Your access credentials are stored encrypted. Communications between your browser and our servers use SSL/TLS encryption (HTTPS).
- Access Control: We limit access to your Personal and Telemetry Data to personnel who need to know it to operate, develop or improve the Service.
- Monitoring: We monitor activity for unauthorized access.
However, no transmission over the Internet or electronic storage system is 100% secure. By using our Service, you acknowledge and accept this residual risk.
9. YOUR RIGHTS AS DATA SUBJECT (Law 81 of 2019)
Law 81 of 2019 of Panama grants you rights over your Personal Data. You may exercise them free of charge by contacting us at support@wimsedas.com:

- Attach a copy of your identification document (ID card or passport) to verify your identity.
- We will respond to your request within a maximum period of fifteen (15) business days, as stipulated by law.
10. MINORS
Our Service is not directed to persons under 18 years of age. We do not knowingly collect Personal Data from minors. If we become aware that we have collected such data without verifiable parental consent, we will take steps to delete it.
11. INTERNATIONAL DATA TRANSFER
Your Personal and Telemetry Data may be processed on servers located within or outside the Republic of Panama (for example, if we use cloud providers such as AWS, Google Cloud or DigitalOcean). By accepting this policy, you give your explicit consent for such international transfer, provided that wimsedas.com will implement adequate safeguards (such as standard contractual clauses) to protect your information, as permitted by Law 81 of 2019.
12. CHANGES TO THIS POLICY
We may update this Privacy Policy occasionally. We will post the new version on our website with a new "last updated" date. If we make material changes, we will notify you by email or through a prominent notice on our platform. Your continued use of the Service after the effective date of the changes constitutes your acceptance of the modified policy.
